Otter POS Sweepstakes
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. THIS SWEEPSTAKES IS VOID WHERE PROHIBITED BY LAW. The Sweepstakes is sponsored by Restaurant Technology Solutions, LLC (d/b/a Otter) located at 633 W 5th St, Suite 11, Los Angeles, CA 90071.
1. Eligibility
This Sweepstakes is open only to legal U.S. residents who are at least eighteen (18) years of age or the age of majority in their state of residence (which is nineteen (19) in Alabama and Nebraska, and twenty-one (21) in Mississippi) as of the date of entry (the “Entrant”). Entrants must be an owner or operator of a licensed food establishment within the United States. This offer is void in U.S. territories and all jurisdictions outside the 50 United States.
Officers, directors, managers, and employees of Sponsor, its respective parents, subsidiaries, affiliates, and related companies, advertising and promotion agencies, consultants, and agents, as well as immediate family members and/or those living in the same household of each such person are not eligible to participate. “Immediate family member” shall be-deemed to mean husband, wife, children, mother, father, sister, or brother.
2. Sweepstakes Period
The Sweepstakes will operate in distinct periods, with each period consisting of the duration specified by the Sponsor (each, a "Sweepstakes Period"). The Sponsor’s computer is the Sweepstakes’ official clock. Sponsor reserves the right to end this Sweepstakes promotion at any time, in its sole discretion. For the initial run, the Sweepstakes Period will end on December 31, 2025.
3. How to Enter
There are two (2) ways to enter:
A. Online Entry: To enter, eligible participants must visit the dedicated Sweepstakes landing page on the Otter POS website and fully complete the official entry form. The form requires providing Full Name, Restaurant Name, Email Address, and Phone Number. Entrants must affirmatively check boxes confirming they are the owner of a licensed food establishment and are 18 years of age or older.
B. Mail-In Alternate Method of Entry (AMOE): To enter without completing the online form, legibly handwrite your complete name, mailing address, phone number, email address, and restaurant name on a postcard or a card that is no smaller than 3 ½ x 5 inches and no larger than 4 ¼ x 6 inches, and mail it with proper postage to: Restaurant Technology Solutions, LLC, ATTN POS Giveaway, 633 W 5th St, Suite 11, Los Angeles, CA 90071. All mail-in entries must be postmarked by the last day of the Sweepstakes Period and received within 5 days thereafter. Each postcard/card is considered one (1) entry. No mechanical reproductions will be accepted.
Entry Limits: There is a limit of one (1) entry per restaurant per Sweepstakes period, regardless of the method of entry. Multiple restaurants under the same ownership must submit separate entries to be eligible. Any attempt by an Entrant to obtain more than the stated number of entries by using multiple/different identities or any other methods will void that Entrant’s entry and that Entrant may be disqualified.
Sponsor is not responsible for any entry that is lost, late, illegible, stolen, mutilated, incomplete, invalid, postage-due, misdirected, or undeliverable, whether due to system errors, omissions, or other failures.
4. Winner Selection, Notification, and Claims
A. Drawing: One (1) potential winner will be selected for each Sweepstakes Period. The winner will be drawn at random by the Sponsor or its designated agent on or about the 15th day of the month following the end of the Sweepstakes Period.
B. Notification: The potential winner will be contacted via both the email address and phone number provided on the entry form (the "Notification") within approximately 48 hours of the drawing.
C. Claims: The potential winner must respond to the Notification within five (5) business days. The potential winner will be required to sign and return (except where prohibited) an Affidavit of Eligibility and Liability/Publicity Release and a W-9 tax form (the “Paperwork”) within fourteen (14) days of the Notification. After verification of the Paperwork, the Prize will be shipped to the winner.
If a potential winner fails to return the Paperwork within the date and time indicated, fails to respond to the Notification, or is found to be ineligible, or if he/she does not comply with the Official Rules, such potential winner and his/her entry will be disqualified and another potential winner will be selected from the remaining eligible entries.
5. Prize Details
One (1) winner per period will receive a complete Otter POS system (the "Prize"). The Prize package includes:
- One (1) Dual Screen Terminal
- One (1) Receipt Printer
- One (1) Secure Card Reader
- A waiver of the standard POS Software Subscription Fee (valued at approximately $1,200 per year)
- A waiver of standard setup fees
- The hardware is subject to the standard hardware warranty.
NOT Included in the Prize:
- Credit/Debit Card Processing Fees: The winner will be responsible for all credit/debit card processing fees. The winner must sign a standard Otter POS Contract to establish service.
- Any other hardware, accessories, or software modules not explicitly listed above.
- Ongoing support services beyond the standard hardware warranty.
A. Total ARV: The combined approximate retail value (ARV) of the Prize is $4,500.
B. Odds of Winning: The odds of winning a Prize depend on the total number of eligible entries received.
C. Prize Restrictions: Limit of one (1) prize per person/household. The right to receive a prize is non-assignable and non-transferable. No prize substitution, exchange or cash equivalent will be allowed, except by Sponsor, who reserves the right to substitute a prize of equal or greater value. Sponsor will not replace any lost or stolen prizes.
D. Taxes: The value associated with the Prize is taxable as income. The winner is solely responsible for any and all applicable federal, state, and local taxes. The Sponsor must report the value of the Prize to the Internal Revenue Service in the year the Prize is received, and the value will be reported to the winner in the form of a Form 1099.
6. General Conditions
By participating, entrants fully and unconditionally agree to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding. Sponsor reserves the right in its sole discretion to disqualify any participant who tampers with the operation of the Sweepstakes or violates these Official Rules
7. Limitation of Liability
By participating in the Sweepstakes, you agree to release and hold harmless Sponsor and its parent, subsidiaries, affiliates; and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of a prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors; (c) printing or typographical errors; (d) lost, late, or undeliverable mail or email; (e) errors in the administration of the Sweepstakes; or (f) injury or damage to persons or property. Participants waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, or indirect damages.
8. Disputes
THIS SWEEPSTAKES IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF CALIFORNIA, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN LOS ANGELES COUNTY, CA. PARTICIPANTS AGREE THAT THE RIGHTS AND OBLIGATIONS OF ANY PARTICIPANT SHALL BE RESOLVED INDIVIDUALLY. PARTICIPANTS WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST SPONSOR RELATED TO THIS SWEEPSTAKES.
9. Privacy
Any information participants provide will be used for purposes of this Sweepstakes and for the Sponsor’s general business purposes in accordance with Sponsor’s Privacy Policy, which can be found at https://www.tryotter.com/legal/ca-privacy-policy.
10. Publicity Rights
By accepting a prize, each entrant agrees to allow Sponsor the perpetual right to use his or her name, restaurant name, location, biographical information, and/or likeness for advertising and publicity purposes, worldwide, without notice, review or approval and without additional compensation except where prohibited by law.
11. Winners List
